Text Messaging Terms & Conditions

Synapse Health and its affiliates, subsidiaries, agents, contractors, or vendors (“Synapse” or “we” or “us” or “our”) enables health care providers and individuals to order durable medical equipment or other necessary health care supplies. These Terms and Conditions apply when you opt-in to receive Short Messaging Service text messages for our Synapse Connect platform. Participation in our texting programs is optional. By opting in or participating in our programs, you accept and agree to these Terms and Conditions.

To participate in our programs, you must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Text messaging from us may include recurring texts related to Synapse Connect Platform. Synapse offers a text messaging program whereby Synapse will text message you with information regarding order status updates (“the “Program”).

In providing your phone number and enrolling in text messages, you are representing that you are: (i) the account holder for the mobile telephone number you provided when you opted-in to receiving text messages from Synapse; (ii) a resident of the United States; and (iii) the owner of and responsible for the mobile device you have enrolled. Providing your phone number and enrolling also confirms that you understand that Program text messages are facilitated and monitored by Twilio, our third-party service provider, who sends and receives texts messages on our behalf. With respect to your responses to the Program text messages, any personal information contained in those responses will be used and disclosed subject to the terms of our Privacy Policy (https://www.synapsehealth.com/privacy-policy) as well as the Twilio Privacy Policy (https://www.twilio.com/legal/privacy).

Text messaging from us may include one-time or recurring texts related to the Synapse Connect Platform. The frequency of messages will vary depending on the recurring texting program you enroll in. In all programs, you may text “STOP” [“END” “CANCEL” “UNSUBSCRIBE” or “QUIT”] to opt out of the program and “HELP” for support. You can contact us at 1.888.33.MYDME.

Text messages may include protected health information (PHI). To protect your PHI, we will follow federal and state privacy laws, including the Health Insurance Portability and Accountability Act and its regulations. Since text messaging is unencrypted, there is a risk that PHI could be intercepted or viewed by third parties, including others who access your device. When you choose to receive text messages from us, you do so at your own risk. We will not be liable for any unauthorized access or interception of text communications with us. You understand you have these choices and have elected to opt-in for texting.

The text message program is offered on an AS IS, AS AVAILABLE basis. We do not guarantee the successful delivery of text messages by your wireless provider. Messages sent by text may not be delivered if the mobile device is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of wireless carriers may interfere with message delivery, including the terrain, proximity to buildings, foliage, weather, and the recipient’s equipment. We will not be liable for losses or damages arising from (a) non-delivery, delayed delivery, or misdirected delivery of a text message; (b) inaccurate or incomplete content in a text message; or (c) use or reliance on the content of any text message for any purpose.

Under no circumstances will we be liable for any direct or indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with use of text messaging whether or not we have been advised of the possibility of such damages.

In the event you change or deactivate your wireless telephone number, you agree to promptly update your Synapse account information. We are not liable for any communication or transmission of information by text which happens because you did not report that your mobile number changed. Password-protecting mobile device(s) and enabling encryption, if available, is recommended.
